Terms and Conditions

Article 1 : Entirety

These general conditions express all the obligations of the parties. In this sense, the consumer is deemed to accept without reservation all of the provisions of these general conditions.

Article 2 : Object

The purpose of these general conditions is to define the rights and obligations of the parties in connection with the online sale of goods and services offered by the company Imex Sport to the consumer.

Article 3 : Proof of transaction

The digital registers, kept in the computer systems of the company Imex Sport under reasonable conditions of security, will be considered as proof of communications, orders and payments made between the parties. The filing of purchase orders and invoices is carried out on a reliable and durable support which can be produced as proof.

Article 4 : Product information

  • 4-a : The company Imex Sport presents on its website the products for sale with the necessary characteristics which make it possible to comply with the consumer code, which provides the possibility for the potential consumer to know before taking the final order the essential characteristics of the products that he wants to buy.
  • 4-b : The offers presented by the Imex Sport company are only valid while stocks last.
  • 4-c : Photos and illustrations are for information and are not contractual.

Article 5 : Prices

The prices are indicated in Canadian dollars, taxes are not included and are valid only on the date of the sending of the purchase order by the consumer. They do not take into account the delivery costs, invoiced in addition, and indicated before the validation of the order. Payment of the full price must be made when ordering.

Article 6 : Payment method

To settle their order, the consumer has, at their choice, all the payment methods referred to in the order form. The consumer guarantees to the Imex Sport company that he has the authorizations possibly necessary to use the method of payment chosen by him, during the validation of the order form. The company Imex Sport reserves the right to suspend the processing of any order and any delivery in the event of refusal of authorization of payment by bank card on the part of officially accredited bodies or in the event of non-payment. The company Imex Sport notably reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially settled a previous order or with whom a payment dispute is in progress.

Article 7 : Product availability

The order will be executed no later than 15 days from the day following that on which the consumer placed his order. In case of unavailability of the product ordered, in particular due to our suppliers, the consumer will be informed as soon as possible and will be able to cancel the whole or part of his order.

Article 8 : Delivery terms

The products are delivered to the address indicated by the consumer on the order form. The consumer can, at his request, obtain the sending of an invoice to the billing address and not to the delivery address by validating the option provided for this purpose on the order form. As soon as we proceed with a shipment, you will immediately receive an email informing you.

Article 9 : Delivery problems due to the carrier

Any anomaly concerning the delivery (damage, missing product compared to the delivery slip, damaged package, broken products, etc.) must be imperatively indicated on the delivery slip in the form of "handwritten reservations", accompanied by the client's signature. The consumer must at the same time confirm this anomaly by sending to the carrier within two (2) working days following the delivery date a registered letter with acknowledgment of receipt setting out said complaints. The consumer must send a copy of this letter by email to info@imexsport.ca or by simple mail to:

Article 10 : Delivery errors

  • 10-a : The consumer will have to formulate with the company Imex Sport the very day of the delivery or at the latest the first working day following the delivery, any complaint of error of delivery and / or nonconformity of the products in kind or in quality compared with the indications appearing on the order form. Any complaint made beyond this period will be rejected.
  • 10-b : The formulation of this complaint with the company Imex Sport can be made by email to info@imexsport.ca.
  • 10-c : Any claim not made in the rules defined above and within the time limits could not be taken into account and will release the Imex Sport company from any responsibility towards the consumer.
  • 10-d : In the event of a delivery error or exchange, any product to be exchanged or reimbursed must be returned to the Imex Sport company as a whole and in its original packaging, by Registered Mail, to the following address:

To be accepted, any return must be reported in advance to the company Imex Sport. The shipping costs are the responsibility of the customer, except in the event that it turns out that the product taken back does not correspond to the declaration of origin made by the consumer in the return slip.

Article 11 : Right to retract

The consumer has a period of 7 working days to return, at his expense, products that do not suit him. This period runs from the day of delivery of the consumer's order. If this period expires on a Saturday, Sunday or a public or non-working day, it is extended until the next working day. All returns must be reported and approved in advance with the Imex Sport company by email at info@imexsport.ca. The product must be returned by Registered Mail to:

Only products returned as a whole and in perfect condition for resale will be accepted. Any product that has been damaged will not be refunded or exchanged. In the case of an exchange, the re-shipment will be at the expense of the consumer. In the event of exercise of the right of withdrawal, the company Imex Sport will make every effort to reimburse the consumer within 15 days. The consumer will then be reimbursed by check.

Article 12 : Force majeure

Neither party will have failed in its contractual obligations, insofar as their execution will be delayed, hindered or prevented by a fortuitous event or force majeure. Will be considered as fortuitous event or force majeure all facts or circumstances irresistible, external to the parties, unpredictable, inevitable, independent of the will of the parties and which cannot be prevented by the latter, despite all efforts reasonably possible. The party affected by such circumstances will notify the other within ten working days of the date on which it becomes aware. The two parties will then come together, within one month, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued. If the case of force majeure lasts longer than three months, these general conditions may be terminated by the injured party. Expressly, are considered force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of Quebec courts and tribunals.

Article 13 : Partial invalidation

If one or more stipulations of these general conditions are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent court, the other stipulations will retain their full force and their scope.

Article 14 : Applicable law

These general conditions are subject to Quebec law. This is the case for the substantive rules as well as for the formal rules. In the event of a dispute or complaint, the consumer will first contact the Imex Sport company to obtain an amicable solution. Secondly and in the event of a more pronounced litigation, the courts of Quebec have sole jurisdiction.
